DECISION
We have before us an application by Timothy Gerald Connolly for renewal of a General Manager’s Certificate.
The Police opposed the application because Mr Connolly had incurred a conviction for having driven with excess breath alcohol in October 2010. As a consequence he consented to suspension of his certificate by decision [2011] NZLLA 641, dated 11 July 2011.
Mr Connolly further accepted a recommendation from the Police and District Licensing Agency Inspector that when next the certificate fell due for renewal the period of renewal would only be for 12 months. However, we note that this application was filed with the District Licensing Agency in October 2010, the date of expiry being 11 November 2010. In the circumstances we propose to renew the certificate for two years from the date of expiry, which will effectively be marginally more than one year following the issue of this decision.
We are satisfied as to the matters to which we must have regard in s.126 of the Act and we renew the certificate until 11 November 2012. A notice of renewal is attached to this decision.
