DECISION
This is an application by Jong Kon Park and Mee Sook Park trading in partnership for renewal of an off-licence in respect of premises situated at Shop 2, 160 Symonds Street, Auckland, known as "Cool Mart". The business trades as a grocery store in terms of s.36(1)(d)(ii) of the Act with trading hours authorised between 7.30 am and 12.00 midnight. No changes are sought to the conditions of the licence.
Advertising did not attract any public objection. However, the Police and the District Licensing Agency Inspector opposed the application voicing concerns that the business does not meet the criteria to hold a grocery store off-licence.
Following the production of trading figures, the Police and District Licensing Agency Inspector are now satisfied that the business does meet the criteria and have withdrawn their opposition.
We are satisfied as to the matters to which we must have regard as set out in s.45 of the Act. We renew the licence on the existing terms and conditions until 14 October 2013, that being three years from the first anniversary of the licence, and we authorise the issue of a notice of renewal.
