IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by ANGELICA RANGIMARIE MACFARLANE pursuant to s.123 of the Act for renewal of a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Ms J D Moorhead
DECISION
We have before us an application by Angelica Rangimarie MacFarlane for renewal of a General Manager’s Certificate. In decision [2010] NZLLA 437 we made an order to suspend the certificate.
The ground for the suspension application was that Ms MacFarlane had been apprehended while driving with an excess breath alcohol level culminating in a conviction, fine and disqualification from driving in February this year.
We concluded our decision by concurring with a recommendation from the Police that when next the certificate was due to expire a shortened term of renewal would be appropriate. Ms MacFarlane expressed her acceptance of such a course of action.
Accordingly we are satisfied as to the matters to which we must have regard in s.126 of the Act and we renew the certificate for 12 months until 15 October 2012. A notice of renewal is attached to this decision.
DATED at WELLINGTON this 11th day of November 2011
