DECISION OF THE AUTHORITY

[1] This is an application by Marcus Barry Greer pursuant to s.118 of the Act for a General Manager's Certificate. The application was received by the Auckland District Licensing Agency on 6 September 2010. It was supported with a copy of the required Licence Controller Qualification issued on 6 March 2009.

[2] The application initially attracted opposition from the Police which has since been withdrawn. The District Licensing Agency Inspector also opposed the application as Mr Greer had not attended an interview. There was also an issue as to whether Mr Greer was still employed in the industry. We have been advised by the Inspector, Miss McLeod, that her enquiries at Mr Greer’s place of employment “Margaritas” confirmed that he was no longer working there. She also advised the Authority that the Agency had not received a current reference confirming Mr Greer’s employment in the industry.

[3] There was no appearance by Mr Greer at the hearing. We therefore make the reasonable assumption that he is no longer interested in pursuing the application nor are we able to be satisfied as to the criteria set out in the Act.

[4] The application is accordingly refused.
