DECISION OF THE AUTHORITY
[1] This is an application by Shannon Pollock pursuant to s.118 of the Act for a General Manager's Certificate. The application was received at the Auckland District Licensing Agency on 29 June 2010. At the time Ms Pollock was working at the “Bubble Lounge” in the Viaduct. The application was accompanied by a copy of the required Licence Controller Qualification and a reference.
[2] The Police opposed the application on the basis of the conditions of a working holiday visa which expired on 22 September 2010. The District Licensing Agency Inspector also opposed the application on the basis that Ms Pollock had failed to attend two interviews. We understand that the reason for this is that Ms Pollock has returned to Ireland.
[3] There was no appearance at the hearing and Mr Whittle for the Police was able to confirm that she has not returned to New Zealand.
[4] In the circumstances we are unable to be satisfied as to the criteria set out in s.121 of the Act and we draw the reasonable conclusion that she is no longer interested in pursuing the application. The application is therefore declined.
DATED at WELLINGTON this 9TH day of March 2011
