IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by REGAN PATRICK O’HALLORAN pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Quorum: Mr P M McHaffie
Ms J D Moorhead
DECISION
We have before us an application by Regan Patrick O’Halloran for a General Manager’s Certificate.
The Police opposed the application because Mr O’Halloran had declared in his application form a conviction for a liquor related traffic offence. The District Licensing Agency referred the matter to the Authority for determination at a public hearing. Those proceedings were to have taken place in April 2011.
However, almost two years now having elapsed since the offence with Mr O’Halloran not having again come to the attention of the Police, opposition to the application has been withdrawn.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 17THday of March 2011
