FINAL DECISION

In decision [2010] NZLLA PH 1124, following a public hearing at Napier on 23 September 2010, we adjourned an application by Luana Lee Walker for a General Manager’s Certificate for six months.

The Police and District Licensing Agency Inspector had opposed the application on the basis of Ms Walker’s failure to declare in her application that she had incurred a conviction for a liquor related traffic offence in 2008.

We learnt that the applicant was not currently employed in the hospitality industry. We have made it clear that the Authority is unwilling to grant or renew managers’ certificates unless they are to be used for the purpose for which they are intended.

Following the expiry of the term of adjournment we sought supplementary reports from the Police and the Inspector. Although there is no evidence of any further offending it is revealed that Ms Walker still does not appear to have any current interest in a position in the hospitality industry.

The Inspector is advised that she is currently working for ‘Mr Apple’ a firm of retail orchardists. In the circumstances we are not prepared to grant the application and it is consequently refused.

We make the point that should Ms Walker at any time wish to enter the industry in a managerial capacity there is nothing in this decision that would preclude her filing a further application.
