DECISION
We have before us an application by James Richard Fitzgerald for a General Manager’s Certificate.
The Police and District Licensing Agency Inspector opposed the application because Mr Fitzgerald had incurred a conviction for a liquor related traffic offence that occurred in mid-2009. Additionally it was believed that Mr Fitzgerald was not employed in the hospitality industry.
Two years having now elapsed since the traffic offence, and given that Mr Fitzgerald’s employer has written to confirm his engagement in licensed premises, opposition has been withdrawn. Accordingly we deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
