IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by DAVID JOHN TINDALL pursuant to s.123 of the Act for renewal of a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Dr J Horn
FINAL DECISION
In decision [2010] NZLLA PH 1031, following a public hearing at Rotorua on 13 September 2010, we adjourned an application by David John Tindall for renewal of a General/Club Manager’s Certificate.
The District Licensing Agency Inspector had opposed the application because Mr Tindall was not currently employed in the hospitality industry. We have made it clear that we are unwilling to grant or renew managers’ certificates unless they are being used for the purpose for which they are intended. We elected to adjourn the application for six months to give Mr Tindall an opportunity to gain suitable employment.
Our Secretary has been advised that Mr Tindall now has a managerial position at the “Kawerau Hotel”. A letter of confirmation from the licensee has been provided. Accordingly we will deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard in s.126 of the Act and we grant the application. A notice of renewal is attached to this decision.
DATED at WELLINGTON this 21st day of July 2011
M Langworthy
Deputy Secretary
