IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by DAWIT TADESSE DEMISSIE pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Ms J D Moorhead
FINAL DECISION
In decision [2010] NZLLA PH 456, following a public hearing at Wellington on 27 April 2010, we adjourned an application by Dawit Tadesse Demissie for a General Manager’s Certificate.
The Police had opposed the application because Mr Demissie had listed his occupation as ‘taxi driver’ and it was revealed that such employment as he had in the hospitality industry was sporadic. As a consequence his experience in the management of licensed premises was extremely limited. We adjourned the application to give him an opportunity to gain the necessary experience to equip him for a management role.
Following the period of adjournment our Secretary sought supplementary reports from the Police and Inspector. These reports reveal that Mr Demissie no longer works at the licensed restaurant that he had identified in his application. An attempt by our secretariat to contact the applicant has not received any response.
In the circumstances we take the inference that the application is no longer to be pursued. We are unable to be satisfied as to the matters to which we must have regard in s.121(1) of the Act. Accordingly the application is refused.
DATED at WELLINGTON this 29th day of July 2011
