FINAL DECISION

In decision [2010] NZLLA PH 716, following a public hearing at Hamilton on 6 July 2010, we adjourned an application by Jennifer Tanya Olliver for a General Manager’s Certificate.

The Police had opposed the application because the applicant had been involved in an incident in which she had exhibited unusual and disturbing behaviour. The Police were of the view that this event called in to question Miss Olliver’s suitability to hold a manager’s certificate. We decided to adjourn the application for six months to assure ourselves that there was unlikely to be any repeat of the incident.

Following the period of adjournment our Secretary sought supplementary reports from the Police and Agency Inspector. Although no further matters of concern have emerged, the reports indicate that Miss Olliver has moved away from her former place of residence and they have no knowledge of her current whereabouts. A letter from our secretariat seeking confirmation of her intentions has been returned undelivered.

In the circumstances we take the inference that the application is no longer to be pursued. We are unable to be satisfied as to the matters to which we must have regard in s.121(1) of the Act. Accordingly the application is refused.
