FINAL DECISION

In decision [2010] NZLLA PH 1058, following a public hearing at Wellington on 31 August 2010, we adjourned an application by Mercedes Soledad Aguila for a General Manager’s Certificate.

The application had been filed with the Auckland District Licensing Agency and both the Police and Agency Inspector had opposed the application because Ms Aguila’s work permit was about to expire and she had limited experience of the management of licensed premises. The application was referred to the Authority.

At Ms Aguila’s request the application was transferred to Wellington where she intended to work. We adjourned the application to permit her to regularise her immigration status, provide evidence of having achieved the Licence Controller Qualification prescribed by s.117A of the Act, and to provide a reference from her employer.

None of these deficiencies have been resolved and our secretariat’s subsequent attempts to contact the applicant evoked no response.

In the circumstances we take the inference that the application is no longer to be pursued. We are unable to be satisfied as to the matters to which we must have regard in s.121(1) of the Act. Accordingly the application is refused.
