Last Updated: 27 September 2011
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by ANKIT DARSHIT BHATT pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Mr P M McHaffie
DECISION
We have before us an application by Ankit Darshit Bhatt for a General Manager’s Certificate.
The District Licensing Agency Inspector has no opposition to the application.
The Police oppose the grant of a certificate on the grounds that Mr Bhatt, an Indian national, has had issued to him by Immigration New Zealand a work visa that permits him to undertake employment as a bartender. The Police contend that this precludes his being able to manage licensed premises.
The District Licensing Agency referred the application to the Authority for determination at a public hearing. However, the Police have now advised our Secretary that opposition is withdrawn.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 23rd day of August 2011
