DECISION

We have before us an application by Adrian John Wilson dated 26 January 2011, for suspension of a General Manager’s Certificate held by Pengfei Zhou.

The ground for the application is that the conduct of the manager has been such as to show that he is not a suitable person to hold the certificate.

On 20 Janaury 2011 the Police conducted a routine compliance check in licensed premises known as “Margarita’s”. A 17 year-old male was located in the premises and his presence was brought to the attention of the duty manager, Pengfei Zhou. The minor was subsequently issued with an infringement notice by the Police for being in breach of s.163 of the Act. This was the third occasion on which minors have been located in the premises when Mr Zhou has been the duty manager.

The respondent does not dispute the ground for the application and he has agreed to suspension of his manager’s certificate. Accordingly, we make the following order by consent:

General Manager’s Certificate number GM 085/2007, issued to Pengfei Zhou, is suspended for four weeks from Monday 20 February 2012.
