Last Updated: 6 March 2012

[2012] NZLLA 119

IN THE MATTER of the Sale of Liquor Act 1989

AND

IN THE MATTER of an application by YONG JIN KIM pursuant to s.123 of the Act for renewal of a General Manager’s Certificate

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge J D Hole

Member: Dr J Horn

DECISION

We have before us an application by Yong Jin Kim for renewal of a General Manager’s Certificate.

The application has been referred to the Authority because in 2011 Mr Kim failed to conduct the licensed premises that he was managing, in a proper manner. In decision [2011] NZLLA 1214, by consent, we suspended Mr Kim’s manager’s certificate for eight weeks for various breaches of the Act. At that time Mr Kim also agreed to a shortened term of renewal of his certificate.

We are satisfied as to the matters to which we must have regard in s.126 of the Act and we renew the certificate for 12 months until 1 December 2012. A notice of renewal is attached to this decision.

DATED at WELLINGTON this 13TH day of February 2012
