DECISION
We have before us an application by Brian Geoffrey Lennon for renewal of a General Manager’s Certificate.
The District Licensing Agency Inspector opposed the application because the Police reported that Mr Lennon had incurred a conviction for driving with an excess breath alcohol reading. However, in view of the fact that some time had elapsed since the offence in June 2009 no suspension was sought, although Mr Lennon elected of his own volition to serve a 30 day suspension from 28 February 2011. A truncated term of renewal for one year was recommended.
Given the lapse of time since the offence and that the recommended term of renewal has been also overtaken by time, opposition is now withdrawn and the Inspector has recommended that a full three year term of renewal be approved.
We are satisfied as to the matters to which we must have regard in s.126 of the Act and we grant the application. A notice of renewal is attached to this decision.
