FINAL DECISION
In decision [2011] NZLLA PH 409, following a public hearing at Auckland on 3 May 2011, we adjourned an application by Neil Anthony Ross for General Manager’s Certificate.
The Police had opposed the application on the basis of Mr Ross having incurred convictions for fighting in a public place in February 2009, and for a liquor related traffic offence that took place on 25 December 2009. Additionally, Mr Ross was not employed in the hospitality industry at the time of the hearing.
We elected to adjourn the proceedings for our generally accepted minimum ‘stand-down’ term of two years from the most recent offence, and to give Mr Ross an opportunity to secure appropriate employment.
The Police have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment and Mr Ross is currently employed in licensed premises in Howick. Opposition to the application is now withdrawn.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
