IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by DAVID GRAEME MILLAR pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Quorum: Mr P M McHaffie
Ms J D Moorhead
DECISION
We have before us an application by David Graeme Millar for a General Manager’s Certificate.
The Police opposed the application because Mr Millar had incurred a conviction for having driven with excess breath alcohol content in 2009.
The application was to have been determined at a public hearing but more than two years have now elapsed since the offence occurred and there have been no further concerns. The Police have withdrawn their opposition.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 12TH day of April 2012
