[2012] NZLLA 534

IN THE MATTER of the Sale of Liquor Act 1989

AND

IN THE MATTER of an application by RAKOA CHARTERS LIMITED pursuant to s.18 of the Act for renewal of an on-licence in respect of the vessel based at 31 Westhaven Drive, Auckland, known as "M V Rakoa"

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge J D Hole
Member: Mr P M McHaffie

DECISION

This is an application by Rakoa Charters Limited for renewal of an on-licence in respect of the vessel based at 31 Westhaven Drive, Auckland, known as "M V Rakoa". The business trades as a charter vessel with hours authorised for the sale of liquor at any time on any day. No changes are sought to the conditions of the licence.

Advertising did not attract any public objection and the Police and District Licensing Agency Inspector raised no matters in opposition to renewal. The Medical Officer of Health opposed the application because the licensee had failed to complete a compliance questionnaire. The Agency referred the application to the Authority for determination at a public hearing.

Prior to those proceedings a questionnaire was completed to the satisfaction of the health authorities and opposition has been withdrawn. Accordingly we deal with the matter on the papers.

We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence on the existing terms and conditions until 30 November 2014, that being the anniversary date of the licence and three years from the most recent date of expiry, and we authorise the issue of a notice of renewal.

DATED at WELLINGTON this 23rd day of May 2012
