IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by REGINALD JOSEPH HENNESSY as trustee of HINEMOA STREET TRUST pursuant to s.18 of the Act for renewal of an on-licence in respect of premises situated at 1107 Hinemoa Street, Rotorua, known as “Locker Room”
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Mr P M McHaffie
HEARING at ROTORUA on 16 May 2012
APPEARANCES
Mr R J Hennessy – applicant
Ms D A Meertens – on behalf of
Medical Officer of Health
DECISION OF THE AUTHORITY
[1] Mr Hennessy’s application for the renewal of the on-licence issued in respect of premises known as “Locker Room” was opposed by the Medical Officer Health upon the grounds that inadequate food had been supplied to the premises. This was a breach of a condition of the licence.
[2] At the conclusion of the hearing, Ms Meertens re-inspected the premises. She ascertained that Mr Hennessy’s evidence pertaining to the various measures that he had put in place for the future provision of food was adequate. In these circumstances her opposition to the application was withdrawn.
[3] The Authority is satisfied that the application meets the criteria set out in s.22 of the Act. Accordingly, the application for the renewal of the on-licence is granted.
