DECISION
We have before us an application by Shuo Zhang for a General Manager’s Certificate.
The application was opposed by the Police because Ms Zhang had come to Police attention for an unspecified matter. The Police were also concerned that Ms Zhang had very limited experience in the operation of licensed premises.
The application was scheduled to be heard by the Authority on 8 November 2011 but prior to those proceedings the Authority elected to adjourn the matter by consent for nine months to give the applicant an opportunity to gain the requisite experience, and to satisfy the Police that there would be no further adverse findings.
The Police and Agency Inspector have advised our Secretary that there have been no other matters of concern brought to their attention during the period of adjournment, and opposition to the application is now withdrawn.
Ms Zhang has provided an undertaking that during the initial 12 months’ tenure of the certificate she will only execute her authority to manage licensed premises at 551 Dominion Road, Balmoral, Auckland, known as “Golden Steam Boat”. No such undertaking is infinite and Ms Zhang may apply to the District Licensing Agency Inspector, or to the Authority, to be released from the undertaking at some point in the future.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
