IN THE MATTER of an application pursuant to s.135 of the Act for suspension of General Manager’s Certificate number GM/060/256/2011 issued to TANIA KIM THOMSON
BETWEEN MELISSA REBECCA LEE ARNOLD
(Police Officer of Christchurch)
Applicant
AND TANIA KIM THOMSON
Respondent
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Ms J D Moorhead
DECISION
We have before us an application by Constable M R L Arnold of Christchurch Police dated 23 August 2012, for suspension of a General Manager’s Certificate held by Tania Kim Thomson.
The ground for the application is that the conduct of the manager has been such as to show that she is not a suitable person to hold the certificate.
On Thursday 12 July 2012 Ms Thomson was working as duty manager in licensed premises known as “Hanmer Hot Springs Hotel”. The respondent provided discounted and free alcoholic drinks to a number of patrons without authority to do so.
Ms Thomson received a formal Police warning regarding theft by a person in a special relationship. She lost her employment as a result of the incident and she is not currently employed in licensed premises.
The respondent does not dispute the ground for the application and she has agreed to suspension of her manager’s certificate. Additionally she has agreed that when the certificate is due to expire on 21 September 2012 she will accept a recommended term of renewal of 12 months. The application for renewal will require referral to and determination by the Authority especially given that she is no longer employed in licensed premises.
In the interim we make the following order by consent:
General Manager’s Certificate number GM/060/256/2011, issued to Tania Kim Thomson, is suspended for 15 days from 15 October 2012.
DATED at WELLINGTON this 7th day of September 2012
