DECISION
This is an application by Mehrdad Soulati for renewal of an on-licence in respect of premises situated at 483 Khyber Pass Road, Newmarket, Auckland, known as "Eduardo’s". The business trades as a restaurant with hours authorised for the sale of liquor between 10.30 am and 12.00 midnight. Additionally, a defined outdoor dining area is licensed between 5.00 pm and 12.00 midnight. The applicant seeks to have the outdoor hours removed from the licence and the licensed premises’ area to be reduced by the extent of the outdoor area.
The Police and Agency Inspector do not oppose renewal, but because of some concerns regarding the management and operation of the premises it is recommended that renewal be for a reduced term of 18 months. The applicant has agreed to accept this course of action.
We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence until 17 November 2013, that being 18 months from the most recent date of expiry, and we authorise the issue of a replacement licence and a notice of renewal.
