9 Validating an ex gratia payment made by Dunedin City Council in respect of
certain contracts
Whereas the Dunedin City Council (in this section referred to as the
"Council" ) during the financial year ended on 31 March 1947 paid to Wilkins
and Davies Construction Company, Limited, a company engaged in the work of
raising the Mahinerangi Dam and the erection of a road bridge at Waipori known
as the Edgar E Stark Bridge, sums amounting in all to 3,114 pounds 18
shillings and 1 penny in excess of the amounts which were properly payable
under the contracts for the said works: And whereas the said
excess payments covered only increased costs incurred by the said company in
respect of annual holiday pay, wages, cartage, and materials, and were made in
good faith for the sake of ensuring the completion of the said works and upon
the certificate of the Corporation's Consulting Engineer and in the belief
that the items covered by such payments were in fact extras within the meaning
of the said contracts: And whereas it is desirable to
validate the expenditure of the said moneys: Be it
therefore enacted as follows:
The payment made by the Council to
Wilkins and Davies Construction Company, Limited, of moneys amounting in all
to the sum of 3,114 pounds 18 shillings and 1 penny in excess of the amounts
properly payable under the said contracts is hereby validated and declared to
have been lawfully made.
