Enforcement of conservation relationship agreement
29 Enforcement of conservation relationship agreement
1 The Crown must comply with the conservation relationship agreement while it
is in force.
2 If the Crown fails to comply with the conservation
relationship agreement without good cause, the trustees may enforce the
conservation relationship agreement, subject to the Crown Proceedings Act 1950
.
3 Despite subsection (2), damages or other forms of monetary compensation
are not available as a remedy for a failure by the Crown to comply with the
conservation relationship agreement.
4 To avoid doubt, subsection (3) does
not affect the ability of a court to award costs incurred by the trustees in
enforcing the conservation relationship agreement under subsection (2).
5
Subsection (2) does not affect any contract entered into between the Minister
of Conservation or the Director-General and the trustees, including any
