Exercise of powers and performance of functions and duties
41 Exercise of powers and performance of functions and duties
1 The statutory acknowledgement and deeds of recognition do not affect, and
must not be taken into account by, a person exercising a power or performing a
function or duty under an enactment or a bylaw.
2 A person, in considering a
matter or making a decision or recommendation under an enactment or a bylaw,
must not give greater or lesser weight to the association of Ngāti Hauā with
a statutory area than that person would give if there were no
statutory acknowledgement or deed of recognition for the statutory area.

Subsection (2) does not limit subsection (1).
4 This section is subject to—
a) the other provisions of this subpart; and
b) any obligation imposed on the
Minister of Conservation, the Director-General, or the
Commissioner of Crown Lands by a deed of recognition.
