104 New sections 281A and 281B inserted
The principal Act is amended by inserting, after section 281 , the following
sections: 281A Registrar may waive, reduce, or postpone payment of fee 1 The
Registrar may waive, reduce, or postpone the payment to the Court of any fee
prescribed by regulations made under this Act.
2 The powers in subsection (1)
may be exercised only if— a) the person responsible for paying the fee is
unable to pay the fee in whole or in part; or
b) in the case of proceedings
concerning a matter of public interest, the proceedings are unlikely to be
commenced or continued if the powers are not exercised.
281B Review of
exercise of power by Registrar 1 A person directly affected by the exercise of
a power by a Registrar may apply to an Environment Judge to reconsider the
matter.
2 The application must be by notice to the Registrar and other
persons affected, within 5 working days after the Registrar's determination or
action.
3 The Environment Judge may confirm, modify, or reverse the decision
of the Registrar.
