The Crown may transfer properties and grant easements
119 The Crown may transfer properties and grant easements
1 To give effect to part 6 of the deed of settlement, the Crown (acting by and
through the chief executive of the land holding agency) is authorised— a) to
transfer the fee simple estate in a commercial redress property or a
deferred selection property to the trustees; and
b) to transfer each
leasehold estate in the cross-leased property to the trustees; and
c) to sign
a transfer instrument or other document, or do anything else, as necessary to
effect a transfer.
2 The Minister of Conservation may grant any easement over
a conservation area or reserve that is required to fulfil the terms of the
deed of settlement in relation to a commercial redress property or
deferred selection property.
3 Any such easement— a) is enforceable in
accordance with its terms, despite Part 3B of the Conservation Act 1987 ; and
b) is to be treated as having been granted in accordance with Part 3B of that
Act.
