CHARITABLE COLLECTIONS ACT 2003 (NO. 17 OF 2003) - SECT 51

    (1)     This section applies if—

        (a)     a licence ends while a collection is being carried out under the licence; or

        (b)     the collection ends before the licence authorising the conduct of the collection ends, but the proceeds of the collection are not distributed for the purposes of the collection within 90 days after the earlier of the following events:

              (i)     the day the collection ends;

              (ii)     the day the licence ends.

    (2)     The chief executive may order the licensee to distribute all or any part of the proceeds of the collection for the purposes of the collection.

    (3)     The order must—

        (a)     be in writing; and

        (b)     be given to the licensee; and

        (c)     state a reasonable time within which the distribution is to be made; and

        (d)     contain a statement about the effect of this section.

    (4)     A licensee commits an offence if the licensee—

        (a)     is given an order under this section; and

        (b)     intentionally contravenes the order.

Maximum penalty: 50 penalty units, imprisonment for 6 months or both.
