WORKING WITH VULNERABLE PEOPLE (BACKGROUND CHECKING) ACT 2011 (NO. 44 OF 2011) - SECT 52

Offence—fail to return registration card

    (1)     A person commits an offence if—

        (a)     the person's registration is—

              (i)     suspended or cancelled under section 59; or

              (ii)     surrendered under section 60; and

        (b)     the person does not return the person's registration card to the commissioner as soon as practicable, but within 10 working days, after the day the suspension or cancellation takes effect.

Maximum penalty: 50 penalty units.

Note     For when a suspension or cancellation takes effect, see  s 59 (4).

    (2)     Subsection (1) does not apply to a person if the person's card has been—

        (a)     lost or stolen; or

        (b)     destroyed by someone else.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (2) (see Criminal Code, s 58).

    (3)     An offence against this section is a strict liability offence.
