COURT PROCEDURES RULES 2006 (NO 29 OF 2006) - REG 6842

(SCR o 39 r 24H)

    (1)     An application for an order under rule 6843 (Order relating to taking evidence for Australian or foreign court or tribunal) may only be made by—

    (a)     a person nominated by the requesting court; or

    (b)     if no-one is nominated—the Attorney-General.

Note 1     Pt 6.2 (Applications in proceedings) applies to an application under this rule.

Note 2     If a form is approved under the Court Procedures Act 2004 , s 8 for this provision, the form must be used.

    (2)     An application mentioned in subrule (1) or for any other order under this division must be filed, but need not be served on anyone.
