2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

(1) An employer must not contact an employee outside of the
12
employee's hours of work (including during periods of leave),
13
unless:
14
(a) the reason for the contact is an emergency or a genuine
15
welfare matter; or
16
(b) the employee is in receipt of an availability allowance for the
17
period during which the contact is made.

(2) An employee is not required to monitor, read or respond to emails,
19
telephone calls or any other kind of communication from an
20
employer outside of the employee's hours of work (including
21
during periods of leave) unless the employee is in receipt of an
22
availability allowance for the period during which the
23
communication is made.
24
(3) In this section:
25
availability allowance
, for a period, means an allowance for being
26
rostered, or otherwise directed by an employer, to remain available
27
to perform work during the period.
