INDUSTRIAL CHEMICALS (NOTIFICATION AND ASSESSMENT) ACT 1989 No. 8 of 1990 - SECT 24

Variation of requirements of section 23
24. (1) Where:

   (a)  a person wishes to apply under section 23 for an
        assessment certificate for a new industrial chemical; and

   (b)  the chemical is listed in a prescribed international inventory of
        chemicals; and

   (c)  the Director is satisfied that, because of the listing, adequate
        information is available about particular matters that, but for this
        subsection, would be required to be included in the
        notification statement; the Director may waive the requirement to
        include those matters in the statement.

(2) A person who wishes to apply under section 23 for an assessment
certificate for a new industrial chemical may request the Director in writing
to vary the requirements in relation to the notification statement by:

   (a)  waiving a requirement to include particular matters in the statement;
        or

   (b)  waiving such a requirement and substituting another requirement.

(3) The Director may vary the requirements in the way requested where he or
she is satisfied that:

   (a)  the introduction of the chemical is not against the public interest;
        and

   (b)  the chemical can be assessed adequately under this Act:

        (i)    where paragraph (2) (a) applies - without those matters; or

        (ii)   where paragraph (2) (b) applies - if the other requirement is
               substituted.

(4) The Director must waive the requirement if he or she is satisfied that the
particular matters are irrelevant, or unnecessary, for the assessment of the
chemical.
