Provision of information by health service providers
161A Provision of information by health service providers
(1) It is the duty
of a health service provider involved in the provision of services to or in
respect of an offender to provide the following information on request by a
community corrections officer-- (a) whether or not the offender has attended a
program or any appointment in which the health service provider is involved
that is required by a condition of the offender's parole order or by a
direction of a community corrections officer,
(b) whether or not the offender
has participated in any other activity in which the health service provider is
involved as required by a condition of the offender's parole order or by a
direction of a community corrections officer.
(2) Nothing in this section
requires a health service provider to provide any information relating to
events that occurred during any treatment, program or activity in which the
offender participated.
(3) The offender is taken to have authorised the
provision of information in accordance with this section by the health service
provider.
(4) The provision of information under this section by a health
service provider does not constitute-- (a) a contravention of the
Health Records and Information Privacy Act 2002 or the Privacy and Personal
Information Protection Act 1998 , or
(b) a breach of professional etiquette
or ethics or a departure from accepted standards of professional conduct.
(5)
In this section--
"health service provider" means-- (a) a health service provider within the
meaning of the Health Records and Information Privacy Act 2002 , or
(b) an
individual who provides a health service within the meaning of that Act.
