EVIDENCE ACT 1995 - SECT 126H

126H Exclusion of evidence of protected sexual assault communications

(1) This section applies only in a civil proceeding in which substantially the same acts are in issue as the acts that were in issue in relation to a criminal proceeding.

(2) If evidence was found to be privileged in a criminal proceeding under Division 2 of Part 5 of Chapter 6 of the Criminal Procedure Act 1986 , the evidence may not be adduced in a civil proceeding to which this section applies.
