MOTOR DEALERS AND REPAIRERS ACT 2013 - SECT 77

77 Effect on Australian Consumer Law remedies

(1) A person who has enforced the dealer guarantee under this Division in respect of the condition of or a defect in a motor vehicle is not, if the dealer guarantee is fully complied with, entitled to take action against the motor dealer under the Australian Consumer Law (NSW) in respect of any aspect of the motor vehicle that is made good or repaired under this Division.

(2) A person who has enforced a consumer guarantee in relation to the condition of or a defect in a motor vehicle is not, if the consumer guarantee is fully complied with, entitled to take action against the motor dealer under the dealer guarantee in relation to an aspect of the motor vehicle that has been dealt with under the consumer guarantee.
