Destruction of forfeited tobacco
42 Destruction of forfeited tobacco
(1) The Secretary is to cause all tobacco products forfeited under this
Division to be destroyed.
(2) The person convicted of the offence that
resulted in forfeiture of tobacco products is liable to pay to the Secretary
the reasonable costs incurred in destroying the tobacco products, and any such
costs may be recovered by the Secretary in a court of competent jurisdiction
as a debt due to the Crown.
(3) In proceedings for recovery of the costs of
destroying tobacco products, a certificate signed by the Secretary certifying
the amount of those costs and the manner in which they were incurred is
evidence of the matters certified.
