Destruction or disposal of records
50 Destruction or disposal of records
(1) An employer or person responsible for regulated material must not destroy
or otherwise dispose of any records required to be kept under this Regulation
otherwise than in accordance with this clause. : Maximum penalty--200 penalty
units (in the case of a corporation) and 100 penalty units (in any other
case).
(2) An employer or person responsible for regulated material may, with
the consent of the Authority, destroy or otherwise dispose of any records that
the employer or responsible person is required by this Regulation to keep.
(3) The Authority is not to give consent to the destruction of any records
kept under clause 30 by an employer until at least 5 years after the cessation
of employment with the employer of the employee concerned.
(4) An employer
may forward to the Authority the records kept under this Regulation by the
employer if the employer ceases to carry on business in New South Wales.
(5)
The Authority may dispose of any records forwarded to or kept by the Authority
in accordance with this Regulation.
