FIRE AND EMERGENCY ACT 1996 - SECT 41

Restrictions on sale of notified articles

    (1)     The Minister may, by Gazette notice, prohibit or regulate the sale, use or possession of an article or substance that the Commissioner considers may constitute a risk of fire.

    (2)     A person who sells, uses or possesses an article or substance in contravention of a notice under subsection (1) is guilty of an offence.

    (3)     Where the Commissioner or an authorised person suspects that an article or substance the sale, use or possession of which is prohibited or regulated by a notice under subsection (1) is being sold, used or possessed in contravention of the notice, the Commissioner or authorised person may seize the article or substance and, for that purpose, may enter any land, building, vehicle, vessel or other place in or on which the article or substance is, or is thought to be, situated.
