OMBUDSMAN ACT 2009 (NO 5 OF 2009) - SECT 32

Referral of complaint to complaints entity

    (1)     If a complaint is made to the Ombudsman about a matter that could be the subject of a complaint under an Act to a complaints entity, the Ombudsman may refer the complaint to the entity.

    (2)     The Ombudsman must give written notice of the referral to:

    (a)     the complainant; and

    (b)     the public authority the subject of the complaint; and

    (c)     if the Ombudsman has given notice under section 47 to the responsible Minister – that Minister.
