WORK HEALTH AND SAFETY (NATIONAL UNIFORM LEGISLATION) REGULATIONS (NO 59 OF 2011) - REG 239

Storage of amusement devices

    (1)     The person with management or control of an amusement device at a workplace must ensure that the device is stored so as to be without risk to health and safety.

Maximum penalty:

(a)     in the case of an individual – $3 600.

(b)     in the case of a body corporate – $18 000.

Note for subregulation (1)

Strict liability applies to each physical element of this offence. See section 12B of the Act.

    (2)     The person with management or control of an amusement device at a workplace must ensure that a person who stores the device is a competent person or is under the supervision of a competent person.

Maximum penalty:

(a)     in the case of an individual – $3 600.

(b)     in the case of a body corporate – $18 000.
