2012 A Bill for An Act to amend the Animal Care and Protection Act 2001 to ensure animal welfare obligations apply to acts done under Aboriginal tradition or Torres Strait Islander custom, and to make consequential amendments to the Aboriginal and Torres Strait Islander Communities (Justice, Land and Other Matters) Act 1984, the Aurukun and Mornington Shire Leases Act 1978 and the Nature Conservation Act 1992.
Animal Care and Protection and Other Legislation Amendment Bill 2012 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Animal Care and Protection and 4 Other Legislation Amendment Act 2012. 5 Part 2 Amendment of Aboriginal and 6 Torres Strait Islander 7 Communities (Justice, Land 8 and Other Matters) Act 1984 9 Clause 2 Act amended 10 This part amends the Aboriginal and Torres Strait Islander 11 Communities (Justice, Land and Other Matters) Act 1984. 12 Clause 3 Amendment of s 61 (Right of Aborigines and Torres Strait 13 Islanders to particular natural resources) 14 (1) Section 61(1), `Subject'-- 15 omit, insert-- 16 `Subject to the Animal Care and Protection Act 2001 and'. 17 (2) Section 61(1), after `consumption'-- 18 insert-- 19 `, in the community government or IRC area,'. 20 Page 4
Animal Care and Protection and Other Legislation Amendment Bill 2012 Part 3 Amendment of Animal Care and Protection Act 2001 [s 4] Part 3 Amendment of Animal Care 1 and Protection Act 2001 2 Clause 4 Act amended 3 This part amends the Animal Care and Protection Act 2001. 4 Clause 5 Amendment of s 5 (Act binds all persons) 5 Section 5(1), `8'-- 6 omit, insert-- 7 `7'. 8 Clause 6 Insertion of new s 6A 9 After section 6-- 10 insert-- 11 `6A Relationship with Nature Conservation Act 1992 12 `(1) This Act does not affect the application of the Nature 13 Conservation Act 1992 other than as provided under 14 subsection (2). 15 `(2) This Act applies to an act done, or omission made, by a person 16 for the purposes of either of the following if authorised under 17 the Nature Conservation Act 1992-- 18 (a) taking, keeping or using an animal to exercise 19 Aboriginal tradition or Island custom; 20 (b) using an animal for a scientific purpose. 21 `(3) A person does not commit an offence under this Act only 22 because the person does an act or makes an omission that-- 23 (a) is authorised under the Nature Conservation Act 1992, 24 other than an act or omission mentioned in subsection 25 (2); and 26 (b) would, apart from this subsection, constitute an offence 1 under this Act.'. 2 Page 5

Animal Care and Protection and Other Legislation Amendment Bill 2012 Part 4 Amendment of Aurukun and Mornington Shire Leases Act 1978 [s 11] `41A Killing an animal under Aboriginal tradition, Island 2 custom or native title 3 `(1) This section applies for an offence if the act that constitutes 4 the offence-- 5 (a) involves the killing of an animal; and 6 (b) is done-- 7 (i) in the exercise of native title rights and interests; or 8 (ii) under the authority of another law of the State or 9 the Commonwealth to take the animal to exercise 10 Aboriginal tradition or Island custom; or 11 (iii) under the Aboriginal and Torres Strait Islander 12 Communities (Justice, Land and Other Matters) 13 Act 1984, section 61; or 14 (iv) under the Aurukun and Mornington Shire Leases 15 Act 1978, section 26. 16 Example-- 17 hunting and killing an animal for personal consumption 18 `(2) It is an offence exemption for the offence if the act is done in a 19 way that causes the animal as little pain as is reasonable. 20 `(3) In this section-- 21 take, under the authority of another law, includes take, keep or 22 use under the authority of the Nature Conservation Act 1992.'. 23 Part 4 Amendment of Aurukun and 1 Mornington Shire Leases Act 2 1978 3 Clause 11 Act amended 4 This part amends the Aurukun and Mornington Shire Leases 5 Act 1978. 6 Page 7
