2015 A Bill for An Act to amend the Electoral Act 1992 for particular purposes

 


 

Electoral (Constitutional) Amendment Bill 2015 [s 1] The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Electoral (Constitutional) 3 Amendment Act 2015. 4 Clause 2 Act amended 5 This Act amends the Electoral Act 1992. 6 Clause 3 Amendment of s 82 (Writs by Governor) 7 (1) Section 82(1)(a), after 'election'-- 8 insert-- 9 under the Constitution of Queensland 2001, chapter 2, 10 part 2A 11 (2) Section 82(2)-- 12 omit. 13 Clause 4 Amendment of s 83 (Writs by Speaker) 14 Section 83(1)(a), 'section 82(1)(b)'-- 15 omit, insert-- 16 section 82(b) 17 Clause 5 Amendment of s 84 (Form and content of writs) 18 (1) Section 84(1)(d), from 'which'-- 19 omit, insert-- 20 which must be-- 21 (i) for a writ for a general election--the 22 polling day under the Constitution of 23 Page 4

 


 

Electoral (Constitutional) Amendment Bill 2015 [s 6] Queensland 2001, section 19C, 19D or 1 19E; or 2 (ii) for another writ--a Saturday not less 3 than 26 days, nor more than 56 days, 4 after the day of the issue of the writ; 5 (2) Section 84-- 6 insert-- 7 (4) However, subsections (2) and (3) do not apply to 8 a polling day for a general election. 9 Note-- 10 See the Constitution of Queensland 2001, section 19F. 11 Clause 6 Amendment of s 86 (Change of time limits in writ) 12 Section 86-- 13 insert-- 14 (5) Subsection (1)(a) does not apply to a polling day 15 for a general election. 16 Clause 7 Insertion of new pt 13, div 9 17 Part 13-- 18 insert-- 19 Division 9 Transitional provision for 20 Electoral (Constitutional) 21 Amendment Act 2015 22 427 Amendments do not apply until completion of 23 next general election 24 (1) Despite the amending Act, this Act continues to 25 have effect until the relevant day as if this Act 26 had not been amended by the amending Act. 27 (2) In this section-- 28 Page 5

 


 

Electoral (Constitutional) Amendment Bill 2015 [s 7] amending Act means the Electoral 1 (Constitutional) Amendment Act 2015. 2 next general election means the next general 3 election held after the commencement of the 4 amending Act. 5 relevant day means the day on which the writ for 6 the next general election is returned. 7 Authorised by the Parliamentary Counsel Page 6
