Clause 2.(1) Sections 3 and 14 are taken to have commenced on 16 June 1999. 7
(2) Section 43 commences on 1 January 2000. 8
(3) Section 4 commences on 25 March 2000. 9

(5) Section 12 commences on 1 June 2000. 11

`1236. In this division-- 9
"amended", for a section, means the section as amended by the Local 10
Government and Other Legislation Amendment Act (No. 2) 1999. 11
provisions for councillors' terms of office 12
`Transitional
`1237.(1) Subsection (2) applies to a councillor of a local government 13
elected at the 1997 triennial elections. 14
`(2) The reference in amended section 227(1) to the quadrennial election 15
at which the councillor is elected is taken to be a reference to the 1997 16
triennial elections. 17
`(3) Subsections (4) and (5) apply to a councillor elected at a fresh 18
election for the Cairns or Ipswich City Council held under the Local 19
Government (Cairns, Douglas, Mareeba and Mulgrave) Regulation 1994 20
or Local Government (Brisbane, Esk, Ipswich, Logan and Moreton) 21
Regulation 1994. 22
`(4) The reference in amended section 227(3)(a) to the next quadrennial 23
elections is taken to be a reference to the 1997 triennial elections. 24
`(5) The reference in the regulations to the 2000 triennial elections is 25

assess the application as if a relevant coastal plan were a State planning 10

not apply to the preparation and approval of the plan. 2
`(3) Also, subsection (1) does not apply to the amendment of a coastal 3
plan to make a minor amendment to a coastal plan to-- 4
(a) correct an error in the plan; or 5
(b) make a change, other than a change of substance, in the plan; or 6
(c) if the plan provides that an amendment of a stated type may be 7
made to the plan by amendment under this subsection--make an 8
amendment of that type.'. 9

(c) the Governor in Council is satisfied-- 6
(i) the land comprising the road or part of the road should be 7
included in a zone consistent with the zoning of adjoining 8
lands under the planning scheme; and 9
(ii) the proposed zoning would not substantially affect the public 10
in an adverse way; and 11
(iii) the local government has agreed in writing to the Governor 12
in Council acting under this section. 13
`(2) The Governor in Council may, by gazette notice, zone the land in the 14
way stated in the notice. 15
`(3) The notice takes effect-- 16
(a) if the road has been closed--on gazettal of the notice; or 17
(b) if the road has not been closed--on the closure of the road. 18
`(4) When the notice takes effect, the planning scheme is taken to have 19
been amended in the way stated in the notice as if the process stated in 20
schedule 1 for amending a planning scheme had been followed.'. 21
