Mining and Other Legislation Amendment Bill 2012 Part 2 Amendment of Environmental Protection Act 1994 [s 4] Clause 4 Insertion of new ch 13, pt 19 1 Chapter 13-- 2 insert-- 3 `Part 19 Transitional provision for the 4 Mining and Other Legislation 5 Amendment Act 2012 6 `711 Provision about financial assurance 7 `(1) This section applies to financial assurance for an 8 environmental authority (EA financial assurance) if-- 9 (a) the financial assurance is held by the administering 10 authority immediately before the commencement of the 11 section; and 12 (b) the activity carried out under the environmental 13 authority is a small scale mining activity; and 14 (c) under section 277A, the holder of the authority gives the 15 chief executive a notice asking the chief executive to 16 cancel the authority; and 17 (d) a prescribed condition requires the holder of a mining 18 tenure for carrying out the small scale mining activity to 19 give the administering authority financial assurance for 20 the tenure. 21 `(2) If the amount of the EA financial assurance is equal to the 22 amount required under the prescribed condition (the required 23 amount), the amount of the EA financial assurance is taken to 24 be the financial assurance for the mining tenure. 25 `(3) If the amount of the EA financial assurance is more than the 26 required amount-- 27 (a) the amount of the EA financial assurance that is equal to 28 the required amount is taken to be the financial 29 assurance for the mining tenure; and 30 (b) the administering authority must return to the holder the 31 amount that is more than the required amount. 32 Page 13

Mining and Other Legislation Amendment Bill 2012 Part 3 Amendment of Environmental Protection (Greentape Reduction) and Other Legislation Amendment Act 2012 [s 7] `Subdivision 6 Prescribed conditions 1 `21A Meaning of prescribed condition 2 `(1) A prescribed condition, for a small scale mining activity, is a 3 condition prescribed under a regulation for the carrying out of 4 the activity. 5 Example of a prescribed condition-- 6 a condition about rehabilitating land 7 `(2) Without limiting subsection (1), a prescribed condition may 8 require the holder of a mining tenure for carrying out a small 9 scale mining activity (a small scale mining tenure) to give the 10 administering authority financial assurance of an amount 11 prescribed under a regulation-- 12 (a) before the relevant activity is carried out under the 13 mining tenure; and 14 (b) as security for-- 15 (i) compliance with other prescribed conditions for 16 carrying out the small scale mining activity; and 17 (ii) costs or expenses, or likely costs or expenses, 18 mentioned in section 298. 19 `(3) However, the Minister may recommend to the Governor in 20 Council a regulation imposing a prescribed condition 21 requiring a financial assurance to be given only if the Minister 22 is satisfied the condition is justified having regard to the 23 matters mentioned in section 292(2).'.'. 24 Clause 7 Amendment of s 8 (Insertion of new chs 5 and 5A) 25 (1) Section 8, inserted chapter 5, heading, `for'-- 26 omit, insert-- 27 `and'. 28 (2) Section 8, after inserted section 277-- 29 insert-- 30 Page 15

 


 

Mining and Other Legislation Amendment Bill 2012 Part 3 Amendment of Environmental Protection (Greentape Reduction) and Other Legislation Amendment Act 2012 [s 7] `277A Cancellation of particular environmental authority on 1 holder's request 2 `(1) This section applies to an environmental authority that-- 3 (a) is in effect on the commencement of the section; and 4 (b) is for a mining activity that-- 5 (i) is an eligible ERA; and 6 (ii) is a small scale mining activity; and 7 (iii) is carried out under a mining claim or an 8 exploration permit, including a mining claim that, 9 under the Mineral Resources Act, section 816, has 10 been converted from a mining lease. 11 `(2) The holder of the environmental authority may give the chief 12 executive a notice in the approved form asking the chief 13 executive to cancel the authority. 14 `(3) On receiving a notice under this section, the chief executive 15 must cancel the environmental authority. 16 `(4) If the chief executive cancels an environmental authority, the 17 chief executive must-- 18 (a) give the holder notice of the cancellation; and 19 (b) record the cancellation in the relevant register. 20 `(5) Divisions 2 and 3 do not apply to a cancellation of an 21 environmental authority under this section. 22 `(6) No amount of any annual fee paid by the holder is refundable 23 to the holder because of a cancellation under this section.'. 24 (3) Section 8, inserted section 292, heading, after `assurance'-- 25 insert-- 26 `for environmental authority'. 27 (4) Section 8, inserted section 293, heading, after `authority'-- 28 insert-- 29 `or small scale mining tenure'. 30 Page 16

Mining and Other Legislation Amendment Bill 2012 Part 3 Amendment of Environmental Protection (Greentape Reduction) and Other Legislation Amendment Act 2012 [s 20] small scale mining activity means a mining activity that-- 1 (a) is carried out under a mining claim, for corundum, 2 gemstones or other precious stones, the area of which is 3 not more than 20ha, and that-- 4 (i) does not, or will not, at any time cause more than 5 5ha of land to be significantly disturbed; and 6 (ii) is not, or will not be, carried out in a wild river area 7 or on strategic cropping land or potential SCL 8 under the Strategic Cropping Land Act 2011; and 9 (iii) is not, or will not be, carried out in a watercourse 10 or riverine area; and 11 (iv) is not, or will not be, carried out in or within 1km 12 of an area that, under a regulation, is a category A 13 environmentally sensitive area; and 14 (v) is not, or will not be, carried out in or within 500m 15 of an area that, under a regulation, is a category B 16 environmentally sensitive area; and 17 (vi) is not, or will not be, carried out in an area 18 prescribed under a regulation as a designated 19 environmental area for this definition; and 20 (vii) is not, or will not be, carried out as part of a 21 petroleum activity or a prescribed ERA for which 22 there is an aggregate environmental score 23 prescribed under a regulation; and 24 (viii) is not, or will not be, carried out by more than 20 25 persons at any one time; and 26 (ix) does not, or will not, at any time cause more than 27 5000m2 of land to be disturbed at a camp site; or 28 (b) is carried out under an exploration permit, for minerals 29 other than coal, the area of which is not more than 4 30 sub-blocks and that-- 31 (i) is not, or will not be, carried out in a wild river area 32 or on strategic cropping land or potential SCL 33 under the Strategic Cropping Land Act 2011; and 34 Page 25

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] `136A Obtaining exploration permit by competitive tender 1 `(1) This section applies if the Minister considers it is in the best 2 interests of the State for an exploration permit for a mineral 3 other than coal to be granted for 1 or more sub-blocks by 4 competitive tender. 5 `(2) The Minister may publish a gazette notice (a call for EP 6 (non-coal) tenders) inviting tenders for the exploration 7 permit. 8 `(3) Division 3, subdivisions 2 and 3 apply for the call for EP 9 (non-coal) tenders-- 10 (a) as if-- 11 (i) a reference to a call for EP (coal) tenders were a 12 reference to a call for EP (non-coal) tenders; and 13 (ii) a reference to an exploration permit for coal were a 14 reference to an exploration permit for a mineral 15 other than coal for the sub-blocks the subject of the 16 call; and 17 (b) with any other necessary changes. 18 `(4) The Minister must not act under subsection (2) for a sub-block 19 that is-- 20 (a) in a fossicking area; or 21 (b) the subject of an application for an exploration permit 22 for the same mineral. 23 `Division 3 Obtaining exploration permit for 24 coal 25 `Subdivision 1 Preliminary 26 `136B Application and operation of div 3 27 `(1) This division-- 28 Page 38

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] (a) applies to exploration permits for coal; and 1 (b) provides for a process for the granting of exploration 2 permits for coal-- 3 (i) generally, by competitive tender; or 4 (ii) to a person who holds 1 or more exploration 5 permits for coal for the same land that are 6 surrendered immediately before the grant of the 7 permit. 8 `(2) To remove any doubt, it is declared that an exploration permit 9 for coal can only be granted under this division. 10 `Subdivision 2 Competitive tenders 11 `136C Call for tenders 12 `(1) The Minister may publish a gazette notice (a call for EP 13 (coal) tenders) inviting tenders for an exploration permit for 14 coal. 15 `(2) The call must state-- 16 (a) the proposed area of the permit; and 17 (b) the day and time by which tenders in response to it must 18 be made (the closing time for the call); and 19 (c) that the tenders must be lodged before the closing time 20 for the call; and 21 (d) that details about each of the following are available at a 22 stated place-- 23 (i) any proposed conditions of the permit that are 24 likely to impact significantly on exploration in the 25 proposed area; 26 (ii) the period of not more than 5 years for which the 27 proposed program of work for the permit must 28 apply; 29 Page 39

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] (iii) any criteria (special criteria), other than the 1 prescribed criteria, proposed to be used to decide 2 whether to grant the permit, or to decide its 3 provisions; 4 (iv) whether a process for appointing a preferred 5 tenderer involving a cash bid component is to be 6 used for deciding the call. 7 `(3) The call may state other relevant matters, including, for 8 example, matters relevant to the special criteria and prescribed 9 criteria. 10 `(4) Subsection (2)(d)(i) does not limit the Minister's power under 11 section 136K to decide conditions of the exploration permit if 12 it is granted. 13 `(5) However, the Minister must not act under this section for land 14 if all or any part of the land is-- 15 (a) in a fossicking area; or 16 (b) the subject of an application for an exploration permit 17 for the same mineral. 18 `136D Right to tender 19 `(1) An eligible person may, by a tender made under section 136E, 20 tender for a proposed exploration permit the subject of a call 21 for EP (coal) tenders. 22 `(2) However, the tender can not be made-- 23 (a) after the closing time for the call; or 24 (b) for only part of the area of the proposed exploration 25 permit. 26 `136E Requirements for making tender 27 `A tender for an exploration permit for coal must-- 28 (a) be in the approved form; and 29 (b) be accompanied by a statement-- 30 Page 40

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] (i) specifying a description of the program of work 1 proposed to be carried out under the authority of 2 the exploration permit, if granted; and 3 (ii) specifying the estimated human, technical and 4 financial resources proposed to be committed to 5 exploration work during each year of the 6 exploration permit, if granted; and 7 (c) be accompanied by a statement, separate from the 8 statement mentioned in paragraph (b), detailing the 9 tenderer's financial and technical resources; and 10 (d) be accompanied by the following-- 11 (i) a statement, separate from the statements 12 mentioned in paragraphs (b) and (c), about how 13 and when the tenderer proposes to consult with, 14 and keep informed, each owner and occupier of 15 private or public land on which authorised 16 activities for the proposed exploration permit are, 17 or are likely to be, carried out; 18 Note-- 19 See section 140A for obligations about consulting with 20 particular owners and occupiers. 21 (ii) proof of the tenderer's identity; 22 (iii) the application fee prescribed under a regulation; 23 (iv) if a process for appointing a preferred tenderer 24 involving a cash bid component is to be used for 25 deciding the call--the tenderer's cash bid. 26 `136F Right to terminate call for tenders 27 `(1) The Minister may, by gazette notice, terminate a call for EP 28 (coal) tenders at any time before deciding to grant an 29 exploration permit to an eligible person who has made a 30 tender in response to the call. 31 `(2) All tenders in response to the call lapse when the call is 32 terminated. 33 Page 41

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] `(3) No amount, whether by way of compensation, reimbursement 1 or otherwise is payable by the State to any person for or in 2 connection with the termination. 3 `(4) However, subject to sections 136H(4) and 136J(4), the 4 Minister must refund any tender security given by the 5 tenderer. 6 `136G Amendment of tender 7 `(1) This section provides for the amendments that can be made to 8 a tender in response to a call for EP (coal) tenders. 9 `(2) A proposed program of work included in the tender may be 10 amended at any time until, but not after, the tenderer has 11 become the preferred tenderer for the call. 12 `(3) The tender may be amended, other than as provided by 13 subsection (2), at any time until, but not after, the closing time 14 for the call. 15 `(4) However, subsection (3) does not apply if-- 16 (a) the tenderer is a company; and 17 (b) the change is only a change of name of the tenderer; and 18 (c) the tenderer's Australian company number and 19 Australian registered business name have not changed. 20 `136H Withdrawal of tender 21 `(1) A person who has lodged a tender in response to a call for EP 22 (coal) tenders may lodge a notice withdrawing the tender at 23 any time before the relevant exploration permit is granted. 24 `(2) The withdrawal takes effect when the notice is lodged. 25 `(3) If the preferred tenderer's tender is withdrawn under this 26 section, the withdrawal does not affect the Minister's power to 27 appoint another tenderer, from the tenders made in response to 28 the call, to be the preferred tenderer. 29 `(4) If a tender is withdrawn under this section, the Minister may, 30 if the Minister considers it reasonable in the circumstances, 31 Page 42

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 50] retain the whole or part of any tender security given by the 1 tenderer. 2 `Subdivision 3 Deciding tenders 3 `136I Process for deciding tenders 4 `(1) Subject to section 136K(2) and (3), any process the Minister 5 considers appropriate may be used to decide a call for EP 6 (coal) tenders, including, for example-- 7 (a) a process appointing a preferred tenderer on the tenders 8 made in response to the call (whether or not involving a 9 cash bid component); or 10 (b) a process involving short-listing a group of possible 11 preferred tenderers and inviting them to engage in 12 another round of tendering before appointing a preferred 13 tenderer from that group. 14 `(2) Without limiting subsection (1), the Minister may give a 15 tenderer a notice requiring the tenderer to give the Minister, 16 within the reasonable period stated in the notice, information 17 the Minister reasonably requires to assess the tender. 18 `136J Provisions for preferred tenderers 19 `(1) The Minister may require a preferred tenderer for the call for 20 EP (coal) tenders to-- 21 (a) pay any amounts necessarily incurred, or to be incurred, 22 to enable the exploration permit to be granted; and 23 Example-- 24 amounts required to comply with the Commonwealth Native 25 Title Act, part 2, division 3, subdivision P 26 (b) do all or any of the following within a stated reasonable 27 period-- 28 (i) pay the rental for the first year of the term of the 29 permit under section 138; 30 Page 43

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 140] (d) identify, in the way required under section 62(b), the 1 boundaries of the land to be included in the mining 2 claim or mining claims; and 3 (e) describe all parcels of land the whole or part of which 4 are the subject of the application and state the name and 5 address of each owner of the land and of land that is to 6 be used as access; and 7 (f) describe and identify, in the way required under section 8 62(c), the land proposed to be used as access from a 9 point, the chief executive considers appropriate, outside 10 the boundary of the proposed mining claim or mining 11 claims to the land over which the mining claim or 12 mining claims is sought; and 13 (g) be accompanied by a sketch, map or other graphic 14 representation the chief executive considers appropriate 15 setting out the boundaries of the land to be included in 16 the mining claim or mining claims and the land to be 17 used as access; and 18 (h) be accompanied by a work program for the activities to 19 be carried out under the mining claim or mining claims; 20 and 21 (i) identify the mineral or minerals for which the mining 22 claim or mining claims is sought. 23 `(4) If a mining lease or mining leases are converted to a mining 24 claim or mining claims under this section-- 25 (a) the area of the mining claim or mining claims must 26 include the whole of the surface of the land within the 27 mining lease or mining leases and can not include any 28 other land; and 29 (b) the term of the mining claim or mining claims end on 30 the first of the following to happen-- 31 (i) the day that is 10 years after the conversion; 32 (ii) if only 1 mining lease is converted--the day the 33 term of the mining lease would have ended if it had 34 not been converted; 35 Page 92

 


 

Mining and Other Legislation Amendment Bill 2012 Part 7 Amendment of Mineral Resources Act 1989 [s 140] (iii) if more than 1 mining lease is converted--the first 1 day the term of any of the mining leases would 2 have ended if that mining lease had not been 3 converted. 4 `(5) The Minister must consider an application made under this 5 section and decide to grant or refuse the application. 6 `(6) The Minister may grant the application if satisfied the holder 7 has complied with the conditions of the relevant mining lease 8 and this Act in relation to the lease. 9 `(7) If the Minister decides to grant the application, the chief 10 executive must-- 11 (a) give the applicant notice of the decision; and 12 (b) record particulars of the conversion in the register. 13 `(8) If the Minister decides to refuse the application, the chief 14 executive must give the applicant notice of the decision and 15 reasons for it. 16 `(9) On the recording of the particulars of the conversion in the 17 register-- 18 (a) the relevant mining lease is taken to be a mining claim; 19 and 20 (b) any security deposited under this Act for the lease is 21 taken to be a security deposited for the mining claim. 22 `(10) If a relevant mining lease is subject to a condition that it can 23 not be renewed or further renewed, the converted mining 24 claim is subject to a condition that it can not be renewed. 25 `(11) Without limiting section 81 or subsection (10), a converted 26 mining claim is subject to the conditions decided by the 27 Minister and stated on the notice mentioned in subsection 28 (7)(a). 29 `(12) If the term of a relevant mining lease would, but for this 30 subsection, end before the application is decided, the lease is 31 taken to continue in force until the application is decided. 32 Page 93
