Mineral Resources Amendment
The Parliament of Queensland enacts-- 1

Short
1. This Act may be cited as the Mineral Resources Amendment Act 1999. 3

Commencement
2. This Act commences on the later of-- 5
(a) the day fixed for the commencement of the Native Title 6
(Queensland) State Provisions Amendment Act (No. 2) 1998, 7
section 9;1 or 8
(b) the date of assent of this Act. 9

`Definition
`722A. In this part-- 18
"mining tenement" has the same meaning it has for the native title 19

`Purpose
`722B. This purpose of this part is to state further provisions that apply 2
to the grant of a mining tenement. 3

`What
`772C.(1) For this part, an owner of land has a "strong connection" 5
with the land if the owner lives and works on the land and has lived and 6
worked on the land for a significant part of the owner's lifetime. 7
`(2) Also, an owner of land has a "strong connection" with the land if the 8
person lives and works on the land and lived and worked on the land as part 9
of the family of a former owner before becoming the owner of the land. 10
`(3) In addition, an owner of land has a "strong connection" with the 11
land if-- 12
(a) the owner is a corporation; and 13
(b) a majority of the shareholders in the corporation live and work on 14
the land. 15

`Consultation
`772D.(1) This section applies for ensuring fairness to owners of land in 17
relation to the granting of a mining tenement. 18
`(2) A person who is an owner of, and has a strong connection with, land 19
to which an application for a mining tenement relates has the same right 20
as-- 21
(a) a native title notification party has under part 13, 14, 15, 16 or 17 22
to be notified of the making of the application and to be consulted 23
in relation to entry under the mining tenement when granted; and 24
(b) a registered native title party has under part 14, 15, 16 or 17, in 25
relation to the application, to be consulted, to ask for mediation 26
and to be a party to negotiations. 27
`(3) For-- 28
(a) subsection (2)(a)--parts 13 to 17 apply to the owner, with 29
necessary changes; and 30

(b) subsection (2)(b)--parts 14 to 17 apply to the owner, with 1
necessary changes. 2
`(4) This section applies only to the extent that the right to be notified or 3
consulted or to ask for mediation or to take part in negotiations, does not 4
already exist under this Act.'. 5
