1998 A BILL FOR An Act to amend the Native Title (Queensland) Act 1993, and for related purposes

 


 

s1 6 s4 Native Title (Queensland) State Provisions The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Native Title (Queensland) State 4 Provisions Act 1998. 5 6 Commencement Clause 2.(1) This Act commences on a day to be fixed by proclamation. 7 (2) However, if a provision has not commenced under subsection (1) 8 before the day that is 9 months after the commencement of section 2 of the 9 Native Title Amendment Act 1998 (Cwlth), the provision commences on 10 that day. 11 PART 2--AMENDMENT OF NATIVE TITLE 12 (QUEENSLAND) ACT 1993 13 amended in pt 2 14 Act Clause 3. This part amends the Native Title (Queensland) Act 1993. 15 of s 3 (Objects of Act) 16 Amendment Clause 4. Section 3(1)(d) and (2)(a), after `past acts'-- 17 insert-- 18 `, and intermediate period acts,'. 19

 


 

s5 7 s6 Native Title (Queensland) State Provisions of s 4 (Definitions) 1 Replacement Clause 5. Section 4-- 2 omit, insert-- 3 4 `Definitions `4. In this Act-- 5 "Commonwealth Native Title Act" means the Native Title Act 1993 6 (Cwlth). 7 "NTA", in a section heading, means the Commonwealth Native Title Act. 8 "State mining Act" means any of the following Acts-- 9 · Mineral Resources Act 1989 10 · Petroleum Act 1923 11 · an Act prescribed by regulation. 12 "Wardens Court" means a Wardens Court established under the Mineral 13 Resources Act 1989.'. 14 of s 7 (Object of Part) 15 Amendment Clause 6.(1) Section 7(b)-- 16 renumber as section 7(c). 17 (2) Section 7-- 18 insert-- 19 `(b) validate, under section 22F of the Commonwealth Native Title 20 Act, intermediate period acts attributable to the State;1 and'. 21 1 For what is an "intermediate period act", see the Native Title Act 1993 (Cwlth), section 232A. There are 4 categories of intermediate period acts, called category A, B, C and D intermediate period acts. They are defined in sections 232B to 232E and deal with a number of things, including leasehold and freehold interests in land, other interests in land and waters, and public works.

 


 

s7 8 s 10 Native Title (Queensland) State Provisions of new s 8A 1 Insertion Clause 7. After section 8-- 2 insert-- 3 of intermediate period acts attributable to State 4 `Validation `8A. Every intermediate period act attributable to the State is valid, and is 5 taken always to have been valid.'. 6 of s 9 (Application of remaining provisions of Part) 7 Amendment Clause 8.(1) Section 9(1), from `apply'-- 8 omit, insert-- 9 `apply-- 10 (a) to a past act attributable to the State that is validated by section 8; 11 and 12 (b) to an intermediate period act attributable to the State that is 13 validated by section 8A.'. 14 (2) Section 9(2) and (3)-- 15 omit. 16 of pt 2, div 2 hdg (Effect of validation on native title) 17 Amendment Clause 9. s 10 9 s 10 Native Title (Queensland) State Provisions 2A--Effect of validation of intermediate period acts on native 1 `Division title 2 A intermediate period acts dealing with the granting or 3 `Category vesting of certain interests in land or waters 4 `13AA.(1) This section applies to a category A intermediate period act 5 within the meaning of section 232B(2), (3) or (4) of the Commonwealth 6 Native Title Act.2 7 `(2) The intermediate period act extinguishes all native title in relation to 8 the land or waters concerned. 9 A intermediate period acts that are public works 10 `Category `13AB.(1) This section applies to a category A intermediate period act 11 within the meaning of section 232B(7) of the Commonwealth Native Title 12 Act. 13 `(2) The intermediate period act extinguishes the native title in relation to 14 the land or waters on which, on completion of its construction or 15 establishment, the public work concerned was or is situated. 16 `(3) The extinguishment is taken to have happened when the construction 17 or establishment started. 18 B intermediate period acts 19 `Category `13AC.(1) This section applies to a category B intermediate period act 20 that is wholly or partly inconsistent with the continued existence, enjoyment 21 or exercise of the native title rights and interests concerned. 22 `(2) The intermediate period act extinguishes the native title to the extent 23 of the inconsistency. 24 2 Section 232B (Category A intermediate period acts).

 


 

s 11 10 s 12 Native Title (Queensland) State Provisions C and D intermediate period acts 1 `Category `13AD.(1) This section applies if an intermediate period act is a category 2 C or D intermediate period act. 3 `(2) The non-extinguishment principle applies to the intermediate period 4 act.3 5 13AA to 13AD apply subject to registered indigenous land 6 `Sections use agreements 7 `13AE. Sections 13AA to 13AD apply subject to section 24EBA(6) of 8 the Commonwealth Native Title Act.4 9 `Division 2B--Effect of extinguishment under division 2 or 2A'. 10 of s 13A (Effect of extinguishment (s 15(2) NTA)) 11 Amendment Clause 11. Section 13A, `this Division'-- 12 omit, insert-- 13 `division 2 or 2A'. 14 of pt 2, div 3 hdg (Other effects of validation) 15 Amendment Clause 12. Part 2, division 3, heading, after `validation'-- 16 insert-- 17 `under division 2 or 2A'. 18 3 For category C intermediate period acts, the State must also comply with the Native Title Act 1993 (Cwlth) section 22H (Requirement to notify: mining rights). 4 Section 24EBA (Effect of registration on previous acts covered by indigenous land use agreements)

 


 

s 13 11 s 15 Native Title (Queensland) State Provisions of s 14 (Preservation of beneficial reservations and 1 Amendment conditions (NTA, ss.18 and 15)) 2 Clause 13.(1) Section 14, heading, `conditions'-- 3 omit, insert-- 4 `conditions--past acts'. 5 (2) Section 14(2), `of native title)'-- 6 omit, insert-- 7 `of past acts on native title)'. 8 of new s 14A 9 Insertion Clause 14. After section 14-- 10 insert-- 11 of beneficial reservations and conditions--intermediate 12 `Preservation period acts 13 `14A.(1) This section applies if-- 14 (a) an intermediate period act attributable to the State contains a 15 reservation or condition for the benefit of Aboriginal peoples or 16 Torres Strait Islanders; or 17 (b) the doing of an intermediate period act attributable to the State 18 would affect rights or interests, other than native title rights and 19 interests, of Aboriginal peoples or Torres Strait Islanders, 20 whether arising under legislation, at common law or in equity, 21 and whether or not rights of usage. 22 `(2) Division 2A does not affect a reservation or condition mentioned in 23 subsection (1)(a) or rights or interests mentioned in subsection (1)(b).'. 24 of s 15 (Compensation (NTA, ss.19 and 16)) 25 Replacement Clause 15. s 16 12 s 17 Native Title (Queensland) State Provisions 1 `Compensation `15.(1) Under the Commonwealth Native Title Act, native title holders 2 are, subject to that Act, entitled to compensation because of the validation by 3 this Act of past acts and intermediate period acts attributable to the State. 4 `(2) The compensation is payable by the State.'. 5 of s 18A (Effect of confirmation under Part (s 212(3) 6 Amendment NTA)) 7 Clause 16. Section 18A, `or impair'-- 8 omit. 9 of pts 4-10 10 Replacement Clause 17. Parts 4 to 10-- 11 omit, insert-- 12 `PART 4--CONFIRMATION OF TOTAL OR 13 PARTIAL EXTINGUISHMENT OF NATIVE TITLE BY 14 PARTICULAR PREVIOUS ACTS 15 1--Objects 16 `Division of pt 4 17 `Objects `19. The objects of this part are-- 18 (a) to confirm the total extinguishment of native title by previous 19 exclusive possession acts attributable to the State;5 and 20 5 For the authorising provision, see the Native Title Act 1993 (Cwlth) section 23E (Confirmation of extinguishment of native title by previous exclusive possession acts of State or Territory). s 17 13 s 17 Native Title (Queensland) State Provisions (b) to confirm the partial extinguishment of native title by previous 1 non-exclusive possession acts attributable to the State.6 2 2--Confirmation of extinguishment or partial extinguishment 3 `Division of extinguishment of native title by certain acts that are 4 `Confirmation not public works 5 `20.(1) This section applies to an act that is a previous exclusive 6 possession act under section 23B(2) (including because of section 23B(3)) 7 of the Commonwealth Native Title Act.7 8 `(2) The act extinguishes native title in relation to the land or waters 9 covered by the freehold estate, Scheduled interest8 or lease concerned. 10 `(3) The extinguishment is taken to have happened when the act was 11 done. 12 of extinguishment of native title by certain acts that are 13 `Confirmation public works 14 `21.(1) This section applies to an act that is a previous exclusive 15 possession act under section 23B(7) of the Commonwealth Native Title 16 Act. 17 `(2) The act extinguishes native title in relation to the land or waters on 18 which, on completion of its construction or establishment, the public work 19 concerned was or is situated. 20 `(3) The extinguishment is taken to have happened when the construction 21 or establishment of the public work started. 22 6 For the authorising provision of the Native Title Act 1993 (Cwlth), see section 23I (Confirmation of partial extinguishment of native title by previous non-exclusive possession acts of State or Territory). For what is a "previous non-exclusive possession act", see section 23F of the Native Title Act 1993 (Cwlth). 7 Native Title Act 1993 (Cwlth), section 23B (Previous exclusive possession act) 8 "Scheduled interest" is defined in s 249C of the Native Title Act 1993 (Cwlth).

 


 

s 17 14 s 17 Native Title (Queensland) State Provisions extinguishment provisions do not apply 1 `Other `22. If section 20 or 21 applies to an act, sections 10 to 13AE do not 2 apply to the act. 3 of partial extinguishment of native title by previous 4 `Confirmation non-exclusive possession acts 5 `23.(1) Subject to subsection (2), if a previous non-exclusive possession 6 act is attributable to the State-- 7 (a) to the extent that the act involves the grant of rights and interests 8 that are not inconsistent with native title rights and interests in 9 relation to the land or waters covered by the lease concerned, the 10 rights and interests granted, and the doing of any activity in giving 11 effect to them, prevail over the native title rights and interests but 12 do not extinguish them; and 13 (b) to the extent that the act involves the grant of rights and interests 14 that are inconsistent with native title rights and interests in relation 15 to the land or waters covered by the lease concerned-- 16 (i) if, apart from this Act, the act extinguishes the native title 17 rights and interests--the native title rights and interests are 18 extinguished; and 19 (ii) in any other case--the native title rights and interests are 20 suspended while the lease concerned, or the lease as 21 renewed, remade, regranted, or extended, is in force; and 22 (c) any extinguishment under this subsection is taken to have 23 happened when the act was done. 24 `(2) This section does not apply if the act is the grant of a pastoral lease 25 or an agricultural lease to which section 109 applies. 26 `(3) If this section applies to an act, sections 10 to 13AE do not apply to 27 the act. 28 9 Section 10 (Category A past acts that are not public works (Native Title Act 1993 (Cwlth), ss 18 and 14(a))

 


 

s 17 15 s 17 Native Title (Queensland) State Provisions `Division 3--Effect of confirmation of total or partial extinguishment of 1 native title 2 of beneficial reservations and conditions 3 `Preservation `24.(1) If-- 4 (a) a previous exclusive possession act attributable to the State 5 contains a reservation or condition for the benefit of Aboriginal 6 peoples or Torres Strait Islanders; or 7 (b) the doing of a previous exclusive possession act attributable to the 8 State would affect rights or interests, other than native title rights 9 and interests, of Aboriginal peoples or Torres Strait Islanders, 10 whether arising under legislation, at common law or in equity and 11 whether or not rights of usage; 12 neither section 20 or 21 affects the reservation or condition or the rights 13 or interests. 14 `(2) If-- 15 (a) a previous non-exclusive possession act attributable to the State 16 contains a reservation or condition for the benefit of Aboriginal 17 peoples or Torres Strait Islanders; or 18 (b) the doing of a previous non-exclusive possession act attributable 19 to the State would affect rights or interests, other than native title 20 rights and interests, of Aboriginal peoples or Torres Strait 21 Islanders, whether arising under legislation, at common law or in 22 equity and whether or not rights of usage; 23 section 23 does not affect the reservation or condition or the rights or 24 interests. 25 of validity of use of certain land held by State etc. 26 `Confirmation `25. To remove doubt, it is declared that if an act is a previous exclusive 27 possession act because of section 23B(9C)(b) of the Commonwealth Native 28

 


 

s 17 16 s 17 Native Title (Queensland) State Provisions Title Act, the use of the land or waters concerned as mentioned in that 1 paragraph is valid.10 2 3 `Notification `26. For a previous non-exclusive possession act to which 4 section 23F(3)(c)(ii) of the Commonwealth Native Title Act applies-- 5 (a) notice must be given, in the way decided in writing by the 6 Commonwealth Minister, to any representative Aboriginal/Torres 7 Strait Islander bodies, registered native title bodies corporate and 8 registered native title claimants in relation to the land or waters 9 that will be affected by the act about the doing or proposed doing 10 of the act, or acts of that class, in relation to the land or waters 11 concerned; and 12 (b) the persons given notice must be given an opportunity to 13 comment on the act or class of acts.11 14 15 `Compensation `27.(1) Under the Commonwealth Native Title Act, native title holders 16 are, subject to that Act, entitled to compensation for any extinguishment 17 under this part of their native title rights and interests. 18 `(2) However, the native title holders are entitled to compensation only to 19 the extent, if any, that the native title rights and interests were not 20 extinguished otherwise than under this Act. 21 `(3) The compensation is payable by the State.'. 22 10 For the authorising provision, see section 23E of the Native Title Act 1993 (Cwlth) (Confirmation of extinguishment of native title by previous exclusive possessive acts of State or Territory). 11 For the authorising provision see section 23I of the Native Title Act 1993 (Cwlth) (Confirmation of partial extinguishment of native title by previous non-exclusive possession acts of State or Territory).
