2014 A Bill for An Act to provide for the development and implementation of the Queensland Plan and related purposes

 


 

Queensland Plan Bill 2014 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 1 Short title 3 This Act may be cited as the Queensland Plan Act 2014. 4 2 Act binds all persons 5 This Act binds all persons, including the State. 6 3 Main purposes of Act 7 The main purposes of this Act are to-- 8 (a) provide for the development and ratification of a plan, 9 known as the Queensland Plan, that-- 10 (i) establishes a long-term vision for the future growth 11 and prosperity of Queensland; and 12 (ii) reflects the aspirations of the community, business 13 and industry for the future of Queensland; and 14 (b) provide for the implementation of the Queensland Plan, 15 including by-- 16 (i) developing a government response to the 17 Queensland Plan and aligning the policies, 18 programs and services of public authorities to the 19 strategic direction of the government response; and 20 (ii) aligning local government planning to the strategic 21 direction of the Queensland Plan; and 22 (iii) encouraging the community, business and industry 23 to implement the Queensland Plan; and 24 Page 6

 


 

Queensland Plan Bill 2014 Part 2 The Queensland Plan [s 4] (c) establish the ambassadors council to advocate for the 1 implementation of the Queensland Plan by the 2 community, business and industry. 3 4 Definitions 4 The dictionary in schedule 2 defines particular words used in 5 this Act. 6 Part 2 The Queensland Plan 7 5 Premier to facilitate development of plan 8 (1) The Premier must facilitate the development of a plan to 9 provide a long-term vision for key areas affecting the future 10 growth and prosperity of Queensland. 11 (2) The key areas under the plan may include, for example, the 12 following-- 13 · education 14 · community 15 · regions 16 · economy 17 · health and wellbeing 18 · environment 19 · people 20 · infrastructure 21 · governance. 22 (3) The plan must-- 23 (a) be developed having regard to the principles stated in 24 schedule 1; and 25 Page 7

 


 

Queensland Plan Bill 2014 Part 2 The Queensland Plan [s 6] (b) outline the strategic direction for the key areas under the 1 plan; and 2 (c) set targets, and include measures, for the key areas. 3 6 Ratification of plan by Legislative Assembly 4 (1) The Premier must table a plan developed under section 5 in 5 the Legislative Assembly for ratification. 6 (2) On being ratified by the Legislative Assembly, the plan has 7 effect as the Queensland Plan. 8 7 Chief executive to publish the Queensland Plan 9 The chief executive must-- 10 (a) publish the Queensland Plan on a government website; 11 and 12 (b) make the Queensland Plan available for inspection, free 13 of charge, during business hours at the department's 14 head office. 15 Editor's notes-- 16 1 The government website for the Queensland Plan is at 17 . 18 2 The department's head office is at 100 George Street, Brisbane. 19 Page 8

 


 

Queensland Plan Bill 2014 Part 3 Implementation of the Queensland Plan [s 8] Part 3 Implementation of the 1 Queensland Plan 2 Division 1 Premier and Ministers 3 8 Government response to the Queensland Plan 4 (1) The Premier must develop a response to the Queensland Plan 5 (the government response) that outlines a 6 whole-of-government approach for the State's contribution to 7 implementing the Queensland Plan. 8 (2) The government response must-- 9 (a) state the strategic direction (the strategic direction) for 10 the State's contribution to implementing the Queensland 11 Plan; and 12 (b) recognise the role of the community, business and 13 industry in achieving the targets established for the key 14 areas under the Queensland Plan. 15 (3) Also, the government response may-- 16 (a) state the core outcomes to be achieved by a stated public 17 authority; and 18 (b) require a particular strategy or action to be taken by a 19 stated public authority; and 20 (c) state the timeframe within which an outcome is to be 21 achieved or a strategy or action is to be taken. 22 9 Promotion of the Queensland Plan 23 (1) A Minister whose principal ministerial responsibilities 24 include a key area under the Queensland Plan must-- 25 (a) promote awareness of the key area within the 26 community, business and industry; and 27 (b) encourage the community, business and industry, in 28 carrying out their activities, to have regard to-- 29 Page 9

 


 

Queensland Plan Bill 2014 Part 3 Implementation of the Queensland Plan [s 10] (i) the key area; and 1 (ii) the targets established by the Queensland Plan for 2 the key area. 3 (2) In this section-- 4 principal ministerial responsibility, for a Minister, means the 5 public business of the State for which the Minister is given 6 responsibility under administrative arrangements made under 7 the Constitution of Queensland 2001, section 44. 8 Division 2 Public authorities 9 10 Policy, program and service alignment with government 10 response 11 The chief executive of a public authority must ensure the 12 following are consistent with the strategic direction of the 13 government response to the Queensland Plan-- 14 (a) the authority's policies and programs; 15 (b) the services delivered by the public authority. 16 Division 3 Local governments 17 11 Preparation of corporate plans 18 (1) This section applies to a local government preparing a 19 corporate plan. 20 (2) The local government must have regard to the Queensland 21 Plan in deciding the following matters for the corporate 22 plan-- 23 (a) the strategic direction of the local government; 24 (b) the performance indicators for measuring the local 25 government's progress in achieving its vision for the 26 future of the local government area. 27 Page 10

 


 

Queensland Plan Bill 2014 Part 4 Reporting requirements [s 12] Part 4 Reporting requirements 1 12 Annual progress report--Premier 2 (1) The Premier must prepare a report for each financial year on 3 the progress made, during the financial year, to implement the 4 Queensland Plan. 5 (2) In preparing the report, the Premier must consult with the 6 ambassadors council. 7 (3) The Premier must table a copy of the report for a financial 8 year in the Legislative Assembly by 30 November in the 9 following financial year. 10 13 Annual report--public authorities 11 The chief executive of a public authority must ensure the 12 public authority's annual report for each financial year 13 includes a statement about the authority's progress, during the 14 financial year, in developing policies and programs, and 15 delivering services, that are consistent with the strategic 16 direction of the government response to the Queensland Plan. 17 14 Annual report--local governments 18 A local government's annual report for each financial year 19 must include a statement about the local government's 20 actions, during the financial year, in relation to matters in its 21 corporate plan that relate to the Queensland Plan. 22 Part 5 Review of the Queensland Plan 23 and government response 24 15 Periodic review of the Queensland Plan 25 (1) The Premier must review the Queensland Plan-- 26 Page 11

 


 

Queensland Plan Bill 2014 Part 5 Review of the Queensland Plan and government response [s 16] (a) within 5 years after the Queensland Plan takes effect 1 under section 6; and 2 (b) at further intervals of not more than 5 years. 3 (2) The objects of the review include deciding whether-- 4 (a) the long-term vision established by the Queensland Plan 5 for the future of Queensland still reflects the aspirations 6 of the community, business and industry; and 7 (b) the ways of implementing the long-term vision, as stated 8 in the Queensland Plan, can be improved; and 9 (c) having regard to the matters mentioned in paragraphs (a) 10 and (b), the Queensland Plan should be revised. 11 (3) In reviewing the Queensland Plan, the Premier must-- 12 (a) consult with the ambassadors council about the matters 13 mentioned in subsection (2); and 14 (b) consider any issues raised by the council; and 15 (c) engage with the community, business and industry in 16 accordance with the principles stated in schedule 1. 17 16 Revising the Queensland Plan 18 (1) If the Premier decides the Queensland Plan should be revised, 19 the Premier must develop a revised plan. 20 (2) Section 5 applies to the development of a revised plan under 21 this section. 22 (3) In developing the revised plan, the Premier must-- 23 (a) consult with the ambassadors council; and 24 (b) consider any issues raised by the council. 25 17 Ratification of revised plan by Legislative Assembly 26 (1) The Premier must table a revised plan developed under 27 section 16 in the Legislative Assembly for ratification. 28 Page 12

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 18] (2) On being ratified by the Legislative Assembly, the revised 1 plan has effect as the Queensland Plan. 2 18 Review of government response 3 (1) If the revised plan tabled under section 17(1) is ratified by the 4 Legislative Assembly, the Premier must-- 5 (a) review the government response to the Queensland Plan 6 within 6 months after the ratification of the plan; and 7 (b) if the Premier considers it appropriate, revise the 8 government response to the Queensland Plan. 9 (2) Nothing in this section prevents the Premier from reviewing 10 or revising the government response at any other time. 11 Part 6 Queensland Plan Ambassadors 12 Council 13 Division 1 Establishment and functions 14 19 Establishment 15 The Queensland Plan Ambassadors Council is established. 16 20 Functions 17 The ambassadors council has the following functions-- 18 (a) to promote awareness, and advocate for the 19 implementation, of the Queensland Plan within the 20 community, business and industry; 21 (b) to advise the Premier on matters relating to the 22 implementation of the Queensland Plan. 23 Page 13

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 21] 21 Premier may give directions 1 (1) The Premier may give the ambassadors council directions in 2 relation to the performance of its functions. 3 (2) The ambassadors council must perform its functions subject 4 to-- 5 (a) the general direction and control of the Premier; and 6 (b) any specific written directions given to it by the Premier. 7 (3) Without limiting subsection (2)(b), a direction may require the 8 ambassadors council to give the Premier, or provide the 9 Premier with access to, information in its possession about a 10 matter stated in the direction. 11 Division 2 Membership 12 Subdivision 1 Appointment 13 22 Appointment of members 14 (1) The ambassadors council is to consist of not more than 15 15 members appointed by the Premier. 16 (2) In making an appointment, the Premier must have regard to 17 the desirability of the members collectively representing the 18 following-- 19 (a) the community; 20 (b) business or industry; 21 (c) regional Queensland. 22 23 Eligibility for appointment 23 (1) A person is eligible for appointment as a member of the 24 ambassadors council only if the Premier is satisfied-- 25 (a) the person represents 1 or more of the following-- 26 Page 14

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 24] (i) the community; 1 (ii) business or industry; 2 (iii) regional Queensland; and 3 (b) the person has the ability to promote the vision 4 established by the Queensland Plan for the future of 5 Queensland. 6 (2) However, a person is not eligible for appointment as a 7 member of the ambassadors council if the person-- 8 (a) is an insolvent under administration under the 9 Corporations Act, section 9; or 10 (b) is disqualified from managing corporations under the 11 Corporations Act, part 2D.6; or 12 (c) has been convicted of an indictable offence. 13 24 Term of office 14 Subject to this division, a member holds office for the term of 15 no longer than 5 years stated in the member's instrument of 16 appointment. 17 25 Conditions of appointment 18 (1) A member is to be paid the remuneration and allowances 19 decided by the Premier. 20 (2) A member holds office on the terms and conditions, not 21 provided for by this Act, decided by the Premier. 22 26 Chairperson and deputy chairperson 23 (1) The Premier may appoint-- 24 (a) a member of the ambassadors council to be the 25 chairperson of the council; and 26 (b) another member of the ambassadors council to be the 27 deputy chairperson of the council. 28 Page 15

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 27] (2) A member may be appointed as the chairperson or deputy 1 chairperson at the same time as the person is appointed as a 2 member. 3 (3) The chairperson or deputy chairperson holds office for the 4 term, ending not later than his or her term of appointment as a 5 member, stated in his or her appointment as chairperson or 6 deputy chairperson. 7 (4) The deputy chairperson is to act as chairperson-- 8 (a) during a vacancy in the office of chairperson; and 9 (b) during all periods when the chairperson is absent from 10 duty or for another reason can not perform the duties of 11 the office. 12 27 Vacancy in office 13 A member's office becomes vacant if-- 14 (a) the member resigns office by signed notice given to the 15 Premier; or 16 (b) the member becomes a person who is an insolvent under 17 administration under the Corporations Act, section 9; or 18 (c) the member is disqualified from managing corporations 19 under the Corporations Act, part 2D.6; or 20 (d) the member is convicted of an indictable offence; or 21 (e) the member's appointment is terminated by the Premier 22 under subdivision 2. 23 Subdivision 2 Termination of appointment 24 28 Grounds for termination of appointment 25 The Premier may terminate the appointment of a member only 26 if the Premier is satisfied the member-- 27 (a) has been guilty of misconduct; or 28 Page 16

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 29] (b) is incapable of performing the member's duties; or 1 (c) has neglected the member's duties or has performed 2 them incompetently. 3 29 Show cause notice 4 (1) This section applies if the Premier believes a ground exists to 5 terminate the appointment of a member under section 28. 6 (2) The Premier must first give the member a notice (a show 7 cause notice) stating the following-- 8 (a) that the Premier proposes to terminate the member's 9 appointment; 10 (b) the grounds for the proposed termination; 11 (c) an outline of the facts and circumstances forming the 12 basis for the grounds; 13 (d) that the member may, within a stated period (the show 14 cause period), make written representations to the 15 Premier to show why the member's appointment should 16 not be terminated. 17 (3) The show cause period must end at least 28 days after the 18 member is given the show cause notice. 19 30 Representations about show cause notice 20 (1) The member may, within the show cause period, make written 21 representations to the Premier about why the member's 22 appointment should not be terminated. 23 (2) The Premier must consider all representations (the accepted 24 representations) made under subsection (1). 25 31 Ending show cause process without further action 26 If, after considering the accepted representations for the show 27 cause notice, the Premier no longer believes a ground exists to 28 terminate the member's appointment, the Premier-- 29 Page 17

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 32] (a) must not take any further action about the show cause 1 notice; and 2 (b) must give the member a notice that no further action is 3 to be taken about the show cause notice. 4 32 Termination of appointment 5 (1) This section applies if-- 6 (a) there are no accepted representations for the show cause 7 notice; or 8 (b) after considering the accepted representations for the 9 show cause notice, the Premier-- 10 (i) still believes a ground exists to terminate the 11 member's appointment; and 12 (ii) believes the termination of the appointment is 13 warranted. 14 (2) The Premier may terminate the member's appointment. 15 (3) If the Premier decides to take action under subsection (2), the 16 Premier must as soon as practicable give the member written 17 notice of the decision. 18 (4) The decision takes effect on the day the notice is given to the 19 member. 20 Division 3 Proceedings 21 33 Conduct of business 22 Subject to this division, the ambassadors council may conduct 23 its business, including its meetings, in the way it considers 24 appropriate. 25 34 Minimum requirement for meetings 26 The ambassadors council must meet at least twice a year. 27 Page 18

 


 

Queensland Plan Bill 2014 Part 6 Queensland Plan Ambassadors Council [s 35] 35 Presiding at meetings 1 (1) The chairperson is to preside at all meetings of the 2 ambassadors council at which the chairperson is present. 3 (2) If the chairperson is not present at a meeting, the deputy 4 chairperson is to preside. 5 (3) If neither the chairperson nor the deputy chairperson is 6 present at a meeting, a member chosen by the members 7 present is to preside. 8 36 Quorum 9 The quorum at a meeting of the ambassadors council is a 10 majority of its members for the time being. 11 37 Conduct of meetings 12 (1) A question at a meeting of the ambassadors council is decided 13 by a majority of the votes of the members present. 14 (2) Each member present at a meeting has a vote on each question 15 to be decided and, if the votes are equal, the member presiding 16 also has a casting vote. 17 (3) A member who is present at a meeting and abstains from 18 voting is taken to have voted for the negative. 19 (4) A meeting may be held using any technology allowing 20 reasonably contemporaneous and continuous communication 21 between members. 22 Example of use of technology-- 23 teleconferencing 24 (5) A member who takes part in a meeting under subsection (4) is 25 taken to be present at the meeting. 26 38 Minutes 27 The ambassadors council must keep minutes of its meetings. 28 Page 19

 


 

Queensland Plan Bill 2014 Part 7 Miscellaneous [s 39] Part 7 Miscellaneous 1 39 Delegation by Premier 2 (1) The Premier may delegate any of the Premier's functions 3 under this Act to another Minister. 4 (2) In this section-- 5 functions includes powers. 6 40 Regulation-making power 7 The Governor in Council may make regulations under this 8 Act. 9 Part 8 Transitional provision 10 41 Plan developed or tabled before commencement 11 (1) If the Premier develops a plan (the original plan) for the 12 purpose, and in the way, mentioned in section 5 before the 13 commencement of section 5, the original plan is taken to have 14 been developed under that section. 15 (2) If the Premier tables the original plan in the Legislative 16 Assembly for ratification before the commencement of 17 section 6(1), the Premier is taken to have complied with that 18 section in relation to the original plan. 19 Page 20

 


 

Queensland Plan Bill 2014 Schedule 1 Schedule 1 Principles for the Queensland 1 Plan 2 section 5(3) 3 1 Long-term vision 4 The Queensland Plan is to establish a long-term vision for the 5 future of Queensland for implementation by all levels of 6 government and by the community, business and industry. 7 2 Visionary response 8 The Queensland Plan is to position the State to respond 9 effectively and strategically to existing and future economic, 10 social, environmental and other issues. 11 3 Strategic focus 12 The Queensland Plan is to provide a strategic approach to 13 planning for the future of Queensland that-- 14 (a) is coordinated, proactive and long-term; and 15 (b) establishes a clear direction for implementation. 16 4 Community and other involvement 17 The vision established by the Queensland Plan is to be 18 developed through-- 19 (a) community consultation activities held throughout 20 Queensland; and 21 (b) consultation with the following-- 22 (i) the community, business and industry; 23 (ii) entities representing the interests of the 24 community, business or industry; 25 (iii) local governments; 26 Page 21

 


 

Queensland Plan Bill 2014 Schedule 1 (iv) any other entity the Premier considers appropriate. 1 5 Bipartisan participation 2 The process for developing the Queensland Plan is to include 3 bipartisan participation. 4 6 Measurable outcomes 5 The targets and measures included in the Queensland Plan for 6 the key areas under the plan must enable the following matters 7 to be monitored and reported on-- 8 (a) progress in relation to the targets for the key areas; 9 (b) whether the targets for the key areas are achievable. 10 7 Joint responsibility 11 Implementation of the Queensland Plan, including the 12 achievement of targets established by the plan for the key 13 areas under the plan, is the joint responsibility of-- 14 (a) the State; and 15 (b) local governments; and 16 (c) the community, business and industry. 17 Page 22
