1993 A BILL FOR An Act to amend certain Acts relating to transportation

 


 

4 Transport Legislation Amendment (No. 2) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short This Act may be cited as the Transport Legislation Amendment 4 Clause1. Act (No. 2) 1993. 5 6 Commencement Clause2. This Act commences on a day to be fixed by proclamation. 7 PART 2--AMENDMENT OF TRAFFIC ACT AND 8 ANOTHER ACT AMENDMENT ACT 1990 9 Act 10 Amended The Traffic Act and Another Act Amendment Act 1990 is amended 11 Clause3. as set out in this Act. 12 of s.2.25 (Amendment of Schedule) 13 Amendment Clause4. Section 2.25(c)-- 14 omit. 15 of Part 3 (Amendment of State Transport Act 1960) 16 Omission Part 3-- 17 Clause5. omit. 18

 


 

5 Transport Legislation Amendment (No. 2) PART 3--AMENDMENT OF STATE TRANSPORT 1 ACT 1960 2 Act 3 Amended The State Transport Act 1960 is amended as set out in this Part. 4 Clause6. of s.62 (Limits of continuous driving hours) 5 Omission Section 62-- 6 Clause7. omit. 7 of Schedule (Subject matters for regulations) 8 Amendment Clause 12-- 9 Clause8.(1) omit, insert-- 10 `Motor vehicle driving hours and rest periods 11 `12.(1) Providing for the control of drivers of motor vehicles in relation 12 to matters necessary to ensure that drivers are in a fit state of health and 13 wellbeing to drive motor vehicles safely, including, for example, 14 requirements for resting. 15 `(2) Imposing obligations on employers, consignors and other persons 16 for the purpose of ensuring or encouraging drivers to comply with the 17 requirements of regulations made under this clause. 18 `(3) Conferring the following powers on authorised officers-- 19 (a) to stop a motor vehicle; 20 (b) to require the production of documents relating to a motor 21 vehicle, its load or its journey and the driver's or passenger's 22 driver's licence and log book; 23 (c) on reasonable suspicion or knowledge of an offence against this 24 Act, to search a motor vehicle and seize documents mentioned in 25 paragraph (b); 26 (d) to make reasonable arrangements for the removal of motor 27 vehicles stopped by an authorised officer to a safe place, 28

 


 

6 Transport Legislation Amendment (No. 2) including, for example, by requiring reasonable assistance from 1 persons in carrying out the arrangements or by requiring the 2 driver to drive the vehicle to a specified place. 3 `(4) Providing for the liability, or immunity from liability, of persons 4 mentioned in subclause (3)(d) for loss or damage caused by, or arising out 5 of, the giving of assistance by them. 6 `(5) Providing for the keeping, carrying and retaining of records and 7 documents in relation to compliance with regulations made under this 8 clause and for their production to, and inspection by, an authorised officer. 9 `(6) In this clause-- 10 "motor vehicle" means a motor vehicle that-- 11 (a) has a gross vehicle mass of 4.5 tonnes or more; and 12 (b) is prescribed by regulation.'. 13 (2) Clause 14-- 14 omit, insert-- 15 `Forms 16 `14. Providing that the prescribed and other forms that are to be used for 17 the purposes of this Act are the forms approved by the chief executive of 18 the department.'. 19 20 © State of Queensland 1993
