MAINTENANCE ACT 1965 - SECT 114
Service of documents etc.
114 Service of documents etc.
(1) Any document required or permitted by this Act to be served on a person
shall, unless otherwise provided by this Act, be served as if it were a
summons and the provisions of section 113 (1) shall apply accordingly.
(2) If
the court, on evidence on oath or by affidavit, is satisfied that from any
cause any summons or other document required or permitted by this Act to be
served on a person has not been and can not promptly be served on that person,
the court may make such order for substituted or other service of the summons
or other document or for the substitution for service of notice by
advertisement or otherwise as to the court seems just.
(3) Any notice (not
being a document referred to in subsection (1) ) required or permitted by this
Act to be given to a person may, unless otherwise provided by this Act, be
given to that person— (a) by serving it on that person as though it were a
summons under this Act; or
(b) by sending it to that person by registered
post at the person’s usual or last-known place of address or business.
